By not consenting, this throws out a huge red flag, the radio lights up with calls of "We have a refusal' The cursury search can usually be beat if the hiding spot if good enough. The only negative, is that if he does find it, you consented, you're arrested, can't contest it in court with a motion to suppress.

It's quite satisfying not consenting in my opinion. Standing up for your rights. You don't fall prey of their mind games and their domination and power. This is the anarchist way. So, if you don't want to consent, be aware they may call a K9 unit. Therefore, wrap you cannabis while wearing gloves, do this before you leave in a new baggy, so it doesn't have time to permeate. Put it in the middle of the vehile, possible high up so the dog can't smell it. Better safe then sorry.

Then here's a question for you. I was popped at the border patrol area in the US on an obsure shortcut road I take all the time. I've passed that checkpoint all the time and they have dogs out there.

This one time I actually had a pipe and a gram of weed in a backpack in the back of my car I had completely forgotten about(shame on me right?) Unaware of any of the rights I had, I consented to the search because the dog tagged my car. I was arrested and booked but months later the case was dismissed with prejudice just because I kept dragging it out and asking to talk to the city DA. I was lucky, I admit, but if I did not consent to the search would I have been in the wrong? I mean, wasn't it probable cause that the dog targeted me?

fuck the police me and my buddie got pulled over with a half of so pretty potent skunk bud on our way back from a club one night it just so happen to be the K9 unit in which case your automaticly fucked and they took my brand new pipe i was pissed they gave my friend possession but i bailed him out the next day and we got hi as hell

the question that's lingering in my mind is, do they have to have probable cause to bring in the dog??

what if your smoking in your car and you get pulled over can you still tell them they cant search it?

Well, hopefully you wouldn't give them enough of a reason to get you out of the car...But if they did however they do have the right to pat you down to make sure you don't have any weapons or something that could be of harm to them..

If asked to step out of the vehicle I'd respond with...why officer, am I going to be detained?

Hell yeah mark....thats what i'm talking about...But as far as the DOG goes, i would think that the cops are going to be dick heads and say shit like that to scare you into going along with the search
or w/e but, if theres NO probable cause, any thing that happens after you say NO I DO NOT CONSENT ect... is all bullshit, and as long as you stay with in your rights and dont tell them anything about anything, you would most likely have a good chance of fighting your case, because if you can show how your rights were VIOLATED you can then show them some paper with a law suit all over it...... basically you have to play them, the way they are playing you, and remember everything that happend nd how it happend.....

I've read both sides of the "sticking to your rights" vs. "hiding well and allowing a search" argument and both have valid points. It really comes down to reading the cop in the situation and playing it by ear so to speak. Some interstate cops will just give you a ticket rather routinely for speeding and send you on your way because that's what they do, and I find that most local cops tend to want to be heroes and bust "criminals", AKA you and me, and will likely go through whatever hoops necessary to get into your car. The thing that sucks is that those dogs can smell through anything depending on how long its been where its at, so the best advice is to keep it in nested air tight jars if at all possible.

If you do manage to get pulled over, there are some things you can do to help your case and lessen the chance that the cop will care to search. Keep your car in good repair, make sure ALL the lights work, use your blinkers, etc. Its also a good idea to keep your car free of trash. If cops pull over a clean car, they will be able to see everything through the windows without wanting to snoop around, so unless there's a bong laying on the floorboard, he probably won't feel the need to dig around. In high school, way back before I even though about smoking weed, I had a bad ass stereo in my crappy rusted out Cavalier. My car hit around 145 dB easily so I went out to a parking lot in the industrial section on the edge of my town to tune my new head unit I had just finished installing at like 9 PM. A cop pulls up and finds me reading the instruction manual and is flashing his light around in my car looking at stuff while he's talking to me. I was wearing cut off jean shorts and a Limp Bizkit (yeah, I know) shirt and my car was full of garbage, all of which I'm sure made him more suspicious. He eventually asked to search my car like I knew he would, and of course I let the pig search my car because there was nothing in it but garbage. Afterwards, I made sure to thank him for harassing me for being a decent citizen and tuning my stereo outside city limits instead of at my house where I would have woken up a 5 block radius. He then attempted to be nice and told me good luck with my stereo. Yeah, thanks pig!

Anyways, your appearance and how you present yourself and your vehicle give a way a lot of your secrets; whether or not this is ethical is debatable, but what is not debatable is that it happens and more often than not, the cop is right. They are stereotypes for a reason, so if a cop pulls you over in your car full of garbage and you're wearing tie dye and rocking dreadlocks, chances are you are going to get treated a lot worse than an "average" person in the same clean vehicle with "normal" clothes. It sucks, but its a reality of the society we live in, so plan accordingly.

All in all, this is an awesome video, so thanks for posting it.

Oh, and I don't recommend smoking in your car ever! Its kind of like how you shouldn't drink beers in the car. Save it until you get to your destination, because getting pulled over after smoking is not only a buzzkill, but it could also land you and/or your friends in jail because there's no way a cop won't smell it.

My Lawyer told me that the police can lie all day long to you about anything. And they did to me. Ask to have your rights read to you and see what you get for it. Because then you can request a lawyer be present. Talk about pissed cop. Anything you say before rights are read is valunteering info to use in court.

Since what happened to me a little over a year ago. The cops suck ass and cannot be trusted for anything. If you ask me I would rather have crackheads being cops. At least you know they will stick you for a few buck for crack. Cops do it for fun. Because of the way my court deal went, I know for a fact the cops smoked my drank 12 oz's I grew cause they dropped that in court so they didn't have to bring it in court and I heard rumors. Small town.

Here's another point of interest not stated. HAVE YOUR DRIVERS LICENSE ALWAYS. Although you may not think it, cops in most states have the right to arrest you On The Spot for not having a license. I mean immediately step out of the car, no questions, handcuffed, your car is then searched, whether or not you consent. If they find a pipe, they'll call it warm whether or not it was and you bet your Ass your going to jail for a DUI, no field sobriety tests or anything. Simple as that, they do what they want and make up reasons for it. Also, NEVER ADMIT TO ANYTHING, you may think it will just piss the cop off, and if you admit yeah man I was tokin he may just let you off, HA! They have microphones for a reason, assume the cop is Not going to cut you a break. Like the adam and whatshisface video linked, assume the cops cannot relate at all to being human. If your car smells and you have to crack the window and the cop asks you why... well your windows broken. He wont figure out that its not if you have your license, dont consent, play it cool. I disagree with the cigarette part, light that sunabitch as soon as he pulls behind you. You can say your a chain smoker, it may keep him from smelling the stuff in the first place, and if he smells something it will give you a point to argue in court.
