Thread: Confused about marijuana law in California

I DO NOT have a meical marijuana card. Let me state that first. So, if I am under the influence of marijuana in California, WITH NO MARIJUANA/CONTRABAND/PARAPHENELIA ETC. ON ME whatsoever, what can an officer do to me? Lets say I'm smoking in a car not near a school. The car is not mine, and the marijuana is not mine. We get stopped. What can happen to me? What can happen to the driver? I say NORMAL's marijuana laws. It said it is AGAINST the law for the officer to arrest anyone for possesion (under one ounce), but they can for possession WITH INTENT TO SELL. Why do I hear of so many people being arrested for marijuana under one ounce?

That law only effects people with a medical marijuana card. Since you on the other hand, do not have a card, you MAY be charged a felony charge or a misdemeanor. But Luckily you are in CA, and the cops here arnt that bad. I recently got pulled over for smoking ON SCHOOL grounds.The cops were cool about it and were going to let me go but i was on school grounds in the parking lot. But when i went to court, that shit got dismissed. So there was no court. They said the District Attorney dismissed the case. Lukily after that, i decided to get a medical marijuana card, and now i have nothing to worry about.

i dont know about cali but in ohio me and some freinds got popped smokin. the cat that had the pipe was charged with possesion paraphinalia and possesion of a controled substance, the rest of us were charged with drug abuse. wich would have been a $100 fine but it didnt even make it to court.

Given your scenario, a slap on the wrist. The max you can get for a ounce of marijuana in california not as a patient is a 100 dollar fine and is a misdemeanor. Assuming you have nothing on you, they can ticket you for being intoxicated in public if the cops are dicks. If the driver is under the influence then he could technically get a DUI. If you did have more than an ounce, and it was your first drug offense then you have to attend some classes. Only thing you should fear is loosing your sac.
