2 people, 1 house, 1 prescription
I have a hypothetical question I hope someone can answer.
If I own a home with my roommate in CA and if my roommate gets a prescription, am I open to legal problems if plants are found in the house? Thanks |

Thanks for your reply and for the clarification of prescription vs recommendation.
Has there ever been an attempted bust on you that exonerated the home owner because the plants are yours? I guess I'm asking - how has your statement been put to the test? It's all legal until you get caught. |

Well, there have been a couple times where cops had to go in the house. In fact, one time a couple of months ago they supposedly got a phone call from a neighbor about a loud noise and a woman screaming. I told the cops I had no idea what they were talking about, because no one was home and all I was doing was watching YouTube videos.
They repeatedly asked to come inside, so I finally let them in even though I had just smoked prior to them coming to the house (I figured I might as well test out my marijuana recommendation if they said anything about the weed). I showed one cop a tour of the house to make sure no one was here and I wasn't hiding anything, while his partner went out back and checked the backyard (where all my plants are). They didn't say anything about the plants or the potent marijuana stench in the house. They just said it was "all clear" and left the house. I was so relieved.

Nah, I live in the Bay Area. Cops usually don't give a shit. And it's not like we're in an apartment. We live in a house. And I didn't have a big ass garden. I only had 2 plants going.
I didn't just say, "Go on ahead and search my house." I repeatedly said I wasn't the owner of the house, and I couldn't let anyone in. They kept saying they had to do because it was a 911 call. But hell, they could've been making that up for all I know. But as far opening myself to a "potential shitload of legal problems," I don't think so. I am a legal MMJ patient with my doctor's recommendation, and I was well within my county guidelines for cultivation. I have absolutely no worries.
