    Medical marijuana is now a prescription drug in Wa.

    Per the legislature medical marijuana is a prescription drug.

    (x) "Prescription" means an order for controlled substances issued
    12 by a practitioner duly authorized by law or rule in the state of
    13 Washington to prescribe controlled substances within the scope of his
    14 or her professional practice for a legitimate medical purpose.

    rcw 69.51A.030..(1) Advising a qualifying patient about the risks and benefits of medical use of marijuana or that the qualifying patient may benefit from the medical use of marijuana where such use is within a professional standard of care or in the individual physician's medical judgment; or

    rcw 69.51A.010..(5) "Valid documentation" means:

    (a) A statement signed by a qualifying patient's physician, or a copy of the qualifying patient's pertinent medical records, which states that, in the physician's professional opinion, the patient may benefit from the medical use of marijuana;

    (w) "Practitioner" means:
    21 (1) A physician under chapter 18.71 RCW((,)); a physician assistant
    22 under chapter 18.71A RCW((,)); an osteopathic physician and surgeon
    23 under chapter 18.57 RCW((,)); an osteopathic physician assistant under
    24 chapter 18.57A RCW who is licensed under RCW 18.57A.020 subject to any
    25 limitations in RCW 18.57A.040; an optometrist licensed under chapter
    26 18.53 RCW who is certified by the optometry board under RCW 18.53.010
    27 subject to any limitations in RCW 18.53.010((,)); a dentist under
    28 chapter 18.32 RCW((,)); a podiatric physician and surgeon under chapter
    29 18.22 RCW((,)); a veterinarian under chapter 18.92 RCW((,)); a
    30 registered nurse, advanced registered nurse practitioner, or licensed
    31 practical nurse under chapter 18.79 RCW((,)); a naturopathic physician
    32 under chapter 18.36A RCW who is licensed under RCW 18.36A.030 subject
    33 to any limitations in RCW 18.36A.040; a pharmacist under chapter 18.64
    34 RCW or a scientific investigator under this chapter, licensed,
    35 registered or otherwise permitted insofar as is consistent with those
    36 licensing laws to distribute, dispense, conduct research with respect
    37 to or administer a controlled substance in the course of their
    38 professional practice or research in this state.

    I thought the same thing..until i read that!! and wa. supreme ct. case state v. tracy which quoted: only a licensed dr. in wa. may prescribe marijuana...

    So now we need a case which makes this clear from the get go...any volunteers? NO? Guess I gotta be the guinea pig huh.

    I can't believe they were dumb enough to write prescription into the new language. It must have been an accident. Unless they're willing to start the fight for our 10th Amendment rights here in Washington. Would be nice if that was what they're really after. But nurses aren't allowed to write prescriptions anyway so they would have to change that part of the law too.
    Just sounds more like a typical sloppy legislation written by the idiots we keep electing.

    The wa. st. legislature has full control over the practice of medicine and drugs...and they also have the 10th amend. to back them up. And nurses can write what the legislature says they can write, unless it is "unconstitutional".

    Wa. st. delegates wrote a 10th amendment notice/declaration to the president.

    p.s. oregon did it also, only they did it via the bop rescheduling it, here in wa. the bop has no jurisdiction over an herb.

    Now after reading the "state" definition(s) against the Fed. AG guidelines...seems that as long as "state" law authorizes it...well, seems the 10th amend just got dealt.

    Its long overdue for states to reclaim there 10th Amendment rights. The commerce clause has had the shit abused out of it to try and circumvent the 10th Amendment.
